Kindergarten Education Act Essay On January 20, 2012, Republic Act 10157 also known as Kindergar ten Education Act, was being approved. This Act is in relation with the Millennium Development Goals on achieving Education for All (EFA) by the year 2015. Wherein the policy provide an equal opportunities for all children to avail of accessible mandatory and compulsory kindergarten education that effectively promotes the physical, social, intellectual, emotional and skills stimulation and values formation to sufficiently prepare them for formal elementary schooling. It is prerequisite then, for the children that they will pass through kindergarten, the first stage of elementary education system before going to Grade 1. It is also stated in this Act that the Mother tongue-based multilingual education (MTB-MLE) will be implemented as the medium of instruction to kindergarten pupils. Reaction: Kindergarten before is somewhat optional to acquire. And not all have the privilege, the capacity, the money and the chances to take this formative stage in education. With or without it, when a child reaches the age of formal schooling, he can start his elementary education. Being a language teacher myself, I personally experienced and still experiencing the effect of teaching many, but not all, fresh high school students with a meager elementary education foundation. No matter how much teachers will be pointing fingers to whoââ¬â¢s who is to be blamed, it boils down to one factor inadequate knowledge foundation of students. With this R.A. 10157, I believe it is of great help in patching the hole of the crisis. With a good start having a strong foundation in education, the process would then continue as they level up their knowledge and eventually our country will produce more equipped, effective and productive men and women of the society. Recommendation: Whatever policies, programs and projects of our government such as this R.A. 10157 if it is closely monitored and supervised properly by the concern agencies and people behind it, nothing will put into waste and that the common goal will be achievedâ⬠¦to build a stronger and a more productive nation.

It is important to note that, sportsmen are celebrities who are admired by many people. As such, every thing that they do is admired by many people. Thus, when they use drugs and eventualy excell in their sporting life, they motivate most youths into doing the same. Without minding about the dangers of substance abuse, most youths have been influenced by sportmen into drug abuse. Among notable athletes who have been poven to be using performance-enhancing drugs include Alex Rodriguez (A-Rod) who was given a 211 game suspension that lasted for the rest of 2013 season and the entire 2014 season for using performance enhancement drugs (Claudia Shane, 2014). Some of the common elements required to produce the accommodation product are shown in figure 1.2. The list could go on. Whereas many of the identified needs of customers are tangible (e.g. the lift, the guestroom and the hot water) and relate to physical assets, other needs (e.g. security and feeling of well-being) are largely intangible. Since the accommodation forms a major part of product, even in small hotels, the capital outlay or revenue expenditure on the property is proportionately high compared with other businesses. In order for business to be conducted in a hotel, it is essential for at least certain of the physical assets to be actively managed. Although the term facilities management might not be used, elements of facilities management would need to be applied to hotels to achieve business success. It is evolving from a property management, services and maintenance (including cleaning, caretaking, and waste disposal and catering) into a much more proactive, strategic role. In this role, it is also concerned with the design of property and the work environment, purchasing and future management and maintenance of the property thus, it covers a broad area of non-core activities (see Figure 1.3). Such activities could include IT Services and even human resources management. It is strategic role of facilities management which will be developed in this book. The needs of the following people, therefore, have to be considered. Shareholders have an interest in business and property value and the asset value and service standards must be maintained or developed. Employees need an efficient working environment. This is conductive to high morale and to high morale and to high quality and productivity. Customers in a hotel will not only be visiting the establishment, the will, hopefully, enjoy using its facilities. Considerable expertise must go into creating an atmosphere and environment which reinforces the good image of the organization. The local community will be affected by the property. Aspects such as visual appearance, pollution, traffic (as a result of business), employment and the encouragement of local custom must be all managed. Reliable suppliers who provide consistent quality are very important to the success of any organization. They might be providing a service, staff, equipment or supplies. Partnership, strategic alliances and other agreements are some means by which this group can be managed. Recent history gives some indication as to how and why the concept of facilities management, in general, not just in the hospitality industry, has developed in the last decade and the hospitality industry, has developed in the last decade and suggest that although many of the strands are not new, the overall approach does not have a different emphasis. The various factors which may have attributed to the rise in facilities management will now be considered. Facilities costs can be very significant. Stipanuk and Roffman (1992) estimated that a full service hotel of under 125 rooms has an average expense of 11.9 per cent of turnover for property management and energy. With costs, savstings can best be made at the design stage of buildings. The development of ideas on terotechnology (considering life-cycle costs at the planning stage) is yet another probable stimulus for the development of facilities management concepts. In response to the rising awareness of property costs, attempts have been made to forecast total ownership costs of buildings (life-cycle costs) at the planning stage. These costs would include: Initial (fixed costs) + Operating costs + Residual costs (e.g. demolition or sale). The need for flexibility Continuous change of policy, market and methods within organizations is now common. Whereas once, such decisions and changes whereas once, such decisions and changes were momentous and seen to be long-lasting, now they are considered to be more routine. At one time, there was only an occasional need for someone to oversee change whereas now that person is needed full-time. Changes related to physical assets include extending or reducing overall working space, modifying workstations to facilitate changing work methods or achieving building modifications in line with rate of churn (i.e. movement of personnel within the jobs in the building). Obsolescence related to workspace rarely, means physical delay, it often means the right fabric in the place. Such as process of change has been evidenced in hotels with relation to computerization and in restaurants as eating habits change and customer expectations of environment alter. In addition, response time needs to be fast. Downtime is wast e. Hotel rooms are a perishable commodity as those not sold twice tomorrow night. Acknowledgement of the facilities as a major resource of the business itself, often means that premises are used round the clock. Trends in the development of facilities management Many changes in recent years have been technological (e.g. building design and telecommunications). At the same time, human needs and expectations have changed and there is need to bridge the gap between the technical and human (see figure 1.6). Life in Southern Mill Villages, 1900s The Industrial Revolution in America began to develop in the mid-eighteen hundreds after the Civil War. Prior to this industrial growth the work force was mainly based in agriculture, especially in the South (ââ¬Å"Industrial Revolutionâ⬠). The advancement in machinery and manufacturing on a large scale changed the structure of the work force. Families began to leave the farm and relocate to larger settings to work in the ever-growing industries. One area that saw a major change in the work force was textile manufacturing. Towns in the early nineteen hundreds were established around mills, and workers were subjected to strenuous working conditions. It would take decades before these issues were addressed. Until then, people worked and struggled for a life for themselves and their families. While conditions were harsh in the textile industry, it was the sense of community that sustained life in the mill villages. It would be hard to imagine what mill life would have been like if it were not for American photographer, Lewis Hine. Hine was influential in bringing public awareness to many social issues of his time. Born in a rural town in Wisconsin in 1874, Hine dedicated his life to capturing Americaââ¬â¢s cultural landscape through the people in his photographs. He was there when thousands of immigrants took their first steps on American soil at Ellis Island. In World War One he captured on film the heroic efforts of the Red Cross (ââ¬Å"Lewis Wickes Hineâ⬠). But most importantly for this paper, are his accounts of people in the mill villages and textile factories in rural America. 1.0 The pros of risk management Maintaining competitiveness Adverse changes in interest and exchange rates may reduce the competitive position of a company against those with lower levels of gearing or smaller exchange rate exposures, or compared with companies that have taken the precaution of hedging against rate changes. Reduction of bankruptcy risk Adverse movements in interest and exchange rates may jeopardize the continued operation of a company. A classic example is that of a highly geared company with a large proportion of floating rate debt being forced into bankruptcy due to an increase in interest rate. Restructuring of capital obligations Interest rate hedging instruments can be used to restructure a companyââ¬â¢s capital profile by altering the nature of its interest obligations, thereby avoiding the repayment of existing debt or the issuing of new securities. In consequence, considerable savings can be made in respect of call fees and issue costs. At the same time, a wider range of financial sources becomes available to the company. Instead of providing protection from steeply increasing interest rates, the transactions turned out to be highly speculative bets. The complicated tax and financial reporting treatments of derivatives The accounting and tax treatment of derivatives has tended to lag behind the pace of their development owing to the dynamic nature of their markets. The major problem regarding the accounting treatment of derivatives is knowing exactly what information to disclose and how to disclose it. Diversification by shareholders may be superior to hedging An alternative to hedging by individual companies is for shareholders to diversify away interest and exchange rate risk themselves by holding a diversified portfolio of shares, hence saving the costs associated with hedging at a corporate level. If shareholders hold diversified portfolios, some commentators argue that hedging of exposures by individual companies is motivated purely by managementââ¬â¢s desire to safeguard their jobs, rather than a desire to enhance shareholder wealth. 3.0 Conclusion As a conclusion, exchange rate risk and interest rate risk can be managed by the use of both internal and external techniques. Internal techniques allow companies to hedge risk within their own balance sheet by the way in which they structure their assets and liabilities. Alternatively, companies can employ one or more of the many external techniques now available, such as swaps, options, futures and forwards. While these derivative instruments give more scope and flexibility to companies to manage their risk, their associated costs and their complicated nature must be taken into account.

Gideonââ¬â¢s Trumpet Book Report
Gideonââ¬â¢s Trumpet, a well-known book in the field of law was written by Anthony Lewis in 1964 and the book presents us with the true account of a man by the name of Clarence Earl Gideon, a semiliterate transient who is put in prison for breaking and entering and minor stealing. In the book we find a detailed account of the story of a man that managed to become a constitutional landmark. The book is set in the 1960ââ¬â¢s in the beautiful state of Florida. The scenery is always in a courtroom or Gideonââ¬â¢s Jail cell. The setting is set in a time period where there civil unrests existed in equality. The book presents to the reader the story of Clarence Earl Gideon who was a petty thief previously. He conserved his documentation by applying for the slotting of a lawyer for him, and he filed an opportune appeal for doing so to the United States Supreme Court. As luck would have it, even though the Florida courts deprived him of legal representation, the judges appointed Abe Fortas, to dispute his grounds. His triumph, ceaselessly setting up the right of the underprivileged to advocate in criminal act cases in America, was one of the milestone cases of the Warren Court. The book, Gideonââ¬â¢s Trumpet has been penned down by the author in order to call to mind the old times behind the Gideon v. Wainwright court case and the ways in which it made such an everlasting impact on the laws of the United States. This exceptional book scrutinizes the case Gideon v. Wainwright, the milestone 1963 Supreme Court case which detained that impoverished criminal defendants are unconstrained to legal advocates at the expense of the government. Gideonââ¬â¢s Trumpet is an articulate and edifying book which provides the reader with at the imperative tale which has never before occurred in the United States legal system. The book is recited with an adequate amount of side comments on the subject of the legal procedure and communal framework and it also proposes an extensive viewpoint of the ordinary people at the legal system. On August 4, 1961, in the Circuit Court of the 14th Judicial Circuit of Florida, Mr. Gideon was tried and convicted by Judge Robert L McCrary, Jr. During this trial, Mr. Gideon didnââ¬â¢t have a counsel and was accused with burglary for breaking into a pool house in Panama City. Evidence, such as wine and loose change was found on Mr. Gideon. During this trial, Gideon actively seeked a counsel and asked the court on numerous occasions to provide him with a counsel. With each request, the court denied him the right to counsel. Thus, the case was extremely bias. Mr. Gideon had to represent himself against a state prosecutor. Gideon failed to understand the proper procedures in a law case and certain attorney techniques such as questioning the jury for bias opinions and asking relevant questions that lead to a point. Mr. Gideon simply asked questions that didnââ¬â¢t contain any lead and was shut down by the prosecutor. With the most unfavorable conditions, Clarence Earl Gideon was convicted and sentenced to five miserable years in prison. After a short time in jail, Gideon used the sources that were closest to him such as the prison library. Gideon checked out multiple books on law and studied his case. He then sent a petition to the Supreme Court of the United States to appeal the case. Mr. Gideon claimed that his 6th and thus 14 amendment rights have been clearly violated. His appeal went through the proper process and became approved. His efforts and his case caught the eye of case reviewers and thus his petition didnââ¬â¢t just go in the regular pile that went nowhere. The main character in the book is Clarence Earl Gideon. Despite the speculations, Gideon was not a black male but rather a white male with white hair. Gideon was born August 30th, 1910 in Hannibal Missouri. With the age of fifty-one, Gideon had a wrinkled and prematurely aged face. Mr. Gideon had a frail body with a voice and hands that trembled. Mr. Gideon survived off gambling and occasional thefts. Mr. Gideon would often find himself on the wrong side of the law. Gideonââ¬â¢s family had little education. Mr. Gideon ran away from his life of misery at the age of fourteen and ran away to California. From there, his life became the living definition of turmoil and Gideon would find himself in and out of jail. He was sentenced in a juvenile court in Ralls County Missouri for stealing clothes from a country store. In the later part of 1934, Mr. Gideon worked in a shoe factory because that was his skill. Within a short time, he was sentenced for stealing government property to wit a armory. While he was in jail, Gideon sent money back home to his folks. In 1937 through 1940, Gideon remained in jail until he escaped. In 1943, Mr. Gideon escaped prison another time. In 1944, Mr. Gideon was arrested again, this time for falsifying records while he was trying to work in a shoe company. In October 1955, he married his current wife named Ruth Ada Babineaux. Clarence accepted Ruthââ¬â¢s children, paying 8 eighty dollars to take custody of Ruthââ¬â¢s children. In 1956 Clarence received his 1st official son and in 1957 came the second son. Clarence understood the necessity of religion and infused religion on his household by sending the children to class fully prepared. There were other characters in the book. Abe Fortas was the defense attorney who represented Mr. Gideon. Fortas had just turned fifty-two years of age when he was assigned to Gideonââ¬â¢s case. Being born on June 19, 1910 to a modest family, Fortas loved living the grand life of being a lawyer graduating from Yale. Mr. Fortas flies around the world giving lectures and workshops. Fortas really had an interest for law on the philosophical aspects of law, such as what is really right. Fortas was a small man but with very powerful voice. His speech was very low and quail but had a great sense of intellectuality behind it. Justice Jackson was not a strong supporter of the judicial review. He wrote a statement in 1954 referring to the real strength of the Court. Justice Jackson wrote ââ¬Å"The real strength of the position of the Court is probably in its indispensability to government under a written Constitution. It is difficult to see how the provisions of a one-hundred-and-fifty-year-old written document can have much vitality if there is not some permanent institution to translate them into current commands. Two other important characters in the book were Justices Black and Frankfurter. Chapter 6 provides an excellent review of methods of judicial, particularly those employed by Justices Black and Frankfurter. Lewisââ¬â¢s objective in this chapter is to provide the reader with some idea of the difficulty that a justice faces each time he is forced to decide a case. Gideon had lodged his complaint as if there wa s no precedent in the area of right to counsel. Gideon had made no reference to Betts, but the Court could certainly not ignore the presence of Betts in making its decision. At the crux of the issue which Lewis raises in this chapter is judicial review. The principle of judicial review has been accepted; however, the method about which method of judicial review should be used is still very much in question. As previously stated, Justice Frankfurter supposedly employed the judicial self-restraintist mode of judicial review. According to this model, the Court is to defer to the legislature and the states in its decision-making. Frankfurter expressed ââ¬Å"apprehensivenessâ⬠about the Court interjecting its wisdom over that of the popularly elected legislature. In a stark contrast to Frankfurter, Justice Blackââ¬â¢s method of interpretation held the Constitutionââ¬â¢s provisions as ââ¬Å"absoluteâ⬠truths inviolable by the legislature. From this view, Justice Black did not have trouble overturning an act of the legislature that ran afoul of a Constitutional provision. However, as Lewis describes, the differing modes of interpretation employed by Frankfurter and Black are not always logically consistent. Frankfurter did not show deference in striking down the constitutionality of wiretapping and the provision of public funds to parochial schools. Justice Black did not act to strike down such actions as unconstitutional. As Abe Fortas began formulating his argument for the Court, he realized that for a justice like Frankfurter overturning the precedent of Betts would not be a simple task. As a judicial self-restraintist, Frankfurter usually held that the Courtââ¬â¢s opinions were to be made under the guise of stare decisis, which means to stand by a decision. However, Frankfurter was not absolute in conforming to precedent. For instance, he voted to overturn the ââ¬Å"separate but equalâ⬠doctrine proscribed in Plessy v. Ferguson in the case of Brown v. Board of Education of Topeka. For the reasons previously stated, Fortas felt that he would not face similar difficulties in convincing Justice Black to join his argument. Beyond precedent, the issue of federalism also presented a difficulty in Gideonââ¬â¢s case. Federalism has been an issue of utmost importance for the Court ever since its momentous decisions in McCulloch v. Maryland, in which the Court held that the federal governmentââ¬â¢s power to create a bank was superior to the statesââ¬â¢. Relevant to Gideonââ¬â¢s claim was Frankfurterââ¬â¢s belief that the federal government should not impose upon the states to protect individual liberties. Justice Black had little of the same resistance. At the crux of the considerations Fortas was making in regard to the views of Justices Black and Frankfurter was the issue of incorporation. The biggest problem in the book was simply the fact that there was a great injustice done to Clarence Earl Gideon. Gideon felt that there would have been a better chance of him not being convicted if only he had a proper attorney. Gideon also believes that because he is poor, he should really have the right to be appointed a proper counsel. Therefore, Mr. Gideon sends in the petition in order to solve his conflict by having an appeal and have a retrial. In this retrial, Gideon hopes that justice will be served because he didnââ¬â¢t commit that crime. One of the most important events in the book was the landmark case Betts v. Brady. Betts v. Brady was a landmark United States Supreme Court case that denied counsel to indigent defendants when prosecuted by a state. It was overruled by Gideon v. Wainwright. In its decision in Johnson v. Zerbst, the Supreme Court had held that defendants in federal courts had a right to counsel guaranteed by the Sixth Amendment. In Powell v. Alabama, the Court had held that state defendants in capital cases were entitled to counsel, even when they could not afford it; however, the right to an attorney in trials in the states was not yet obligatory in all cases as it was in federal courts under Johnson v. Zerbst. In Betts v. Brady, Betts was indicted for robbery and upon his request for counsel, the trial judge refused, forcing Betts to represent himself. He was convicted of robbery, a conviction he eventually appealed to the Supreme Court on the basis that he was being held unlawfully because he had been denied counsel. At the end of the book, Clarence Gideon was granted a new trial. This time when he appeared for trial in the Circuit Court of Bay County, Florida, Gideon had a lawyer, and the lawyer made a difference. The jury acquitted Gideon in his retrial showing, in just one personââ¬â¢s case, what we know to be true: The right to counsel has profound meaning in the lives of those who are accused. Gideonââ¬â¢s Trumpet was a great book; it had a lot of factual information that was useful in the class. The book was on the subject of law, which I enjoy dearly so it was interesting. After reading this book I obtained a great deal of knowledge on such a landmark case that helped establish a position on such a on going debate.
